 الزواج طريق الاستعفاف

قال تعالى: “وَأَنكِحُواْ ٱلۡأَيَٰمَىٰ مِنكُمۡ وَٱلصَّٰلِحِينَ مِنۡ عِبَادِكُمۡ وَإِمَآئِكُمۡۚ إِن يَكُونُواْ فُقَرَآءَ يُغۡنِهِمُ ٱللَّهُ مِن فَضۡلِهِۦۗ وَٱللَّهُ وَٰسِعٌ عَلِيمٞ (32) وَلۡيَسۡتَعۡفِفِ ٱلَّذِينَ لَا يَجِدُونَ نِكَاحًا حَتَّىٰ يُغۡنِيَهُمُ ٱللَّهُ مِن فَضۡلِهِۦۗ وَٱلَّذِينَ يَبۡتَغُونَ ٱلۡكِتَٰبَ مِمَّا مَلَكَتۡ أَيۡمَٰنُكُمۡ فَكَاتِبُوهُمۡ إِنۡ عَلِمۡتُمۡ فِيهِمۡ خَيۡرٗاۖ وَءَاتُوهُم مِّن مَّالِ ٱللَّهِ ٱلَّذِيٓ ءَاتَىٰكُمۡۚ وَلَا تُكۡرِهُواْ فَتَيَٰتِكُمۡ عَلَى ٱلۡبِغَآءِ إِنۡ أَرَدۡنَ تَحَصُّنٗا لِّتَبۡتَغُواْ عَرَضَ ٱلۡحَيَوٰةِ ٱلدُّنۡيَاۚ وَمَن يُكۡرِههُّنَّ فَإِنَّ ٱللَّهَ مِنۢ بَعۡدِ إِكۡرَٰهِهِنَّ غَفُورٞ رَّحِيمٞ (33) وَلَقَدۡ أَنزَلۡنَآ إِلَيۡكُمۡ ءَايَٰتٖ مُّبَيِّنَٰتٖ وَمَثَلٗا مِّنَ ٱلَّذِينَ خَلَوۡاْ مِن قَبۡلِكُمۡ وَمَوۡعِظَةٗ لِّلۡمُتَّقِينَ (34).

معانى الكلمات الواردة في الآيات 32:34 من سورة النور

الْأَيامى:           جمع أيْمَ، وَهُوَ مَنْ لا زَوجَ لَهُ مِنَ الرِّجالِ والنِّسَاءِ.

عبادِكُم:           الإنسانُ المُسترَقُ المملوك.

وإمائكُم:           مفردها أمة، وهي الأنثى منَ الرّقيق.

وليستعفف:      وليجتهد في طلب العفّة عن الزنا.

الكتاب:               عقد بين العبد وسيده على مبلغ من المال ليعتق نفسه.

مَلَكَتْ أَيْمَتُكُمْ:    الرقيق.

وَاتُوهُم:             أعطوهم.

البغاء:              الزنا بأجر.

أهمية الزواج والهدف منه

شرع الإسلامُ الزواج لحِكَمِ عديدةٍ يعود نفعها على الفرد وعلى المجتمع، لأن الزواج طريق الاستعفاف ومن هذه الحكم:

1- بناء المجتمع وتحصينه بغض البصر وحفظ الفرج:

الزواج هوَ السَّبيل الوحيد لتكوين أسرة على أُسس سليمة، فالأسرة هي اللَّبنة الرئيسة في بناء المجتمع؛ لذلك حثّ الإسلام  ورغب في الزواج فقد قال صلى الله عليه وسلم: ( يا مَعْشَرَ الشَّبَابِ، من اسْتَطَاعَ مِنْكُمُ الْبَاءَةَ فَلْيَتَزَوِّجُ ، فَإِنَّه أَغَضُ لِلْبَصَرِ ، وأَحْصَنُ لِلْفَرْج) (رواه البخاري).

فعدم الارتباط بالأسرة لا يعطي للفرد مجالًا أكبر من الحرية في الوقت والفكر, فلا يستطيع الابتكار والإبداع ويكون الانسان غير مستقر نفسيا ومضطربا داخليا مما يجعله غير قادر على  الابداع الابتكار.

2- تحصين المجتمع بالسكن والمودة والرحمة:

 يحقق الزواج العفاف وأيضا الاستقرار للإنسان المسلم ويبعده عن طريق الحرام، ويقول الله تعالى: ( ومن ءاياته ان خلق لكم من أنفسكم ازواجا لتسكنوا اليها وجعل بينكم مودة ورحمه إن في ذلك لآيات لقوم يتفكرون ) الروم:21. ومتى اعف الانسان نفسه وصانها عن الحرام فقد حصنها من الامراض والآفات المعدية، ومنعها من الانجرار لارتكاب الجرائم، وفى هذا يتحقق تحصين المجتمع وحمايته (طريق الزواج للاستعفاف).

 فالزَّواج يحفظ المجتمع منَ التَّفَكُكِ, فالمصاهرةُ تقوي العلاقاتِ والروابط بينَ الأُسرِ، فيحصل التَّقاربُ والتَّعارفُ،

قالَ تعالى: ( وَهُوَ الَّذِي خَلَقَ مِنَ الْمَاءِ بَشَرًا فَجَعَلَهُ نَسَبًا وَصِهْرَا وَكَانَ رَبُّكَ قَدِيرًا (الفرقان: (54).

3- تكاثر النَّسل:

قَالَ صلى الله عليه وسلم: «تَزَوَّجُوا الْوَدُودَ الْوَلُودَ فَإِنِّي مُكَاثِرُ بِكُمُ الْأُمَمَ» (رواه النِّسائي).

فالذُرِّيَّةُ غايةٌ مقصودةٌ في الشَّريعة الإسلامية، والزَّواجُ هوَ الطَّرِيقُ الصَّحيحُ لتحقيق هـذه الغاية وبها تستقر الحياة، قال تعالى: ( يا أيها الناس اتقوا ربكم الذى خلقكم من نفس واحدة وخلق منها زوجها وبث منهما رجالا كثيرا ونساء واتقوا الله الذى تساءلون به والأرحام ان الله كان عليكم رقيبا) النساء:1.

ومن يدَّعي أن من مظاهرِ التَّحضُّرِ تحديدُ النَّسلِ وعدم الإكثارِ مِنَ الأَولادِ:

فالتحضر الحقيقي يكون بإتباع سنة النبي صلى الله عليه وسلم وهديه بالإكثار من الذرية وتظهر أهمية الذرية عند الحروب والكوارث الطبيعية.

4- بلوغ السموّ الإنساني

للزواج مفعول عجيب في تربية وتهذيب النَّفْسِ البشرية، وتغيير تركيبتها، فالإنسانُ رجلًا كانَ أوِ امرأةً بمجرد التفكير في تكوين أسرة، تتبدل اهتماماته، وتتغير المفاهيم لديه, فكلا لطَّرفِينِ أصبح مسؤولًا عنْ حفظِ عِرْضِ الآخر، وأصبحتِ الشَّهواتُ منظمةً، وبدأ شعورُ الأبوة والأمومة ينمو ويتواجد، وبمجرَّدِ الإنجاب :تبدأ التّضحياتُ بتربية الأبناء والقيام بحقوقِ الأسرة، وبهذا يكونُ الزَّوجُ والزَّوجةُ قد انتقلا من حياة المراهقة إلى حياة المسؤولية المتبادلة، وهذا هو السمو الإنساني بأعلى معانيه.

مخاطر عدم تيسير سبل الزواج 

1- الوقوع في الزنا والمحرمات.

2- ارتفاع نسبة العنوسة.

3- الأمراض النفسية والجسدية.

فالإسلام يعتمد في بناء نظامه الاجتماعي على التدابير الوقائية منعا للجرائم قبل وقوعها, كمـا أنـه لا يـحارب الدوافع الفطرية بل يعززها، ويعمل على تنظيمها، ويضيقُ فرص الغواية، ويبعد عوامل الفتنة.

 التدابير الوقائية التي اتخذها الإسلام لعدم الوقوع في الزنا

أولا: الحث على تزويج الشباب.          ثانيا: الاستعفاف.                   ثالثا: تحريم البغاء واغلاق منافذه.

الشرح والتفصيل

أولا: الحث على تزويج الشباب:

فالمجتمع المسلم يتصف بالأمن، تتحقق فيه الطمأنينة السكينة والاستقرار والسعادة لجميع أفراده.

ويتعاون وتكاتف جميع أفراد المجتمع ستتحقق سبل الراحة والسعادة للجميع وبخاصة الشباب منهم, وقد جاءَتِ الآيات الكريمة توجّه أولياء الأمور لتيسير سبل الزواج للشباب الذين لا زوج لهم.

  مقترحات لتسهيل أمور الزواج

1- توفير المسكن الملائم.

 2- توفير فرص العمل.

 3-عدم المغالاة في المهور.

4- الاقتصاد في تكاليف الأعراس والحفلات.

  دولة الإمارات  وفَرَتْ المساكن، وقامت ببناء صالات الأفراح وإنشاء صندوق الزواج، وغير ذلك مما يساعد في تحقيق مقصد مهم من مقاصد الشريعة، وهو حفظ النسل والعرضُ.

المسؤولية مشتركة في تيسير أمور الزواج:

* فالحاكم يضع قوانين تحد من ارتفاع المهور وكذلك توفير مساكن للراغبين في الزواج.

* الآباء بعدم المغالة في المهور والتكاليف.

* صندوق الزواج بتنظيم الأعراس الجماعية وتقديم المساعدات المالية.

 مقترحات تحد من المغالاة في المهور

1- سَن قوانين من قبل الدولة لمنع المبالغة في المهور.
2- القيام بحملات توعية عن مخاطر المغالاة.
3- اتباع سنة النبي صلى الله عليه وسلم في تقليل المهور.
4- التحذير من المباهاة والتفاخر في غلاء المهور.

معاني الصّلاح في قوله تعالى: ( وَالصَّلِحِينَ مِنْ عِبَادِكُمْ وَإِمَائكُمْ):

1 – صلاح الدين(فزوجوه جزاء لصلاحه).

2 – الصالحون للزواج المحتاجون إليه.

3 – صلاح الاخلاق.

الزواج طلبًا للستر والعفّة قد يكون سببًا لزيادة الرّزق حيث يقول تعالى: ( (إِن يَكُونُوا فُقَرَاء يُغْنِهِمُ اللَّهُ مِن فَضْلِهِ ).

ثانيا: الاستعفاف:

دور الاستعفاف وأهميته في حماية الفرد والمجتمع

الفرق بين العفة والاستعفاف

قال النووي: أما العفاف والعفة، فهو التنزه والبعد عما لا يباح’ والامتناع عنه،  والاستغناء عن الناس، وعدم النظر لما في أيديهم.

أما الاستعفاف فهو ترك ما لا يليق والبعد عما يخرم المروءة، والمروءة هي الوقوف عند محاسن الأخلاق،

قال تعالى: (وَلْيَسْتَعْفِفِ الَّذِينَ لَا يَجِدُونَ نِكَاحًا حَتَّى يُغْنِيَهُمُ اللَّهُ مِن فَضْلِهِ)

عندما يعيش الانسان في بيئة تكون فيها فرص ارتكاب الخطايا بكثرة ويكون التساهل امرا عاديا، فإنه يتطلب أساسا قويا في الأخلاق والسيطرة على الذات, وفى نظر الدين الإسلامي أنَّ أفضل الجهاد هو جهاد النفس ومقاومه رغباتها الغير مشروعه، وطلب العفة والاستعانة بالذكر والصلاة والصوم.

فلا يخلو مجتمع من المجتمعات من فئةِ الشَّبابِ الذينَ هُم في سن الزواج، ولكنهم غير قادرين علـى تكاليف الزواج، فإن كان غير قادر على الزواج فعليه بالاستعفاف، أي الإصرار على العفة والأخلاق الكريمة، وأيضا صيانه حرمات مجتمعهم، مع مواصلة الجد والاجتهاد لتحقيق أهدافهم وطموحاتهم ثقه في ربهم، وبوعده حتى يغنيهم الله من فضله، وقد قال رسول الله صلى الله عليه وسلم: (ثلاثة حق على الله عونهم .. حتى قال .. والناكح الذى يريد العفاف)(النسائي).

 فمن كانت الطهارة والعفة هدفاً لـسعيه وعمله نال رضا الله تعالى, وسهل الله له السبل، وأعانَهُ على الوصول لغايته، قال تعالى: (إِنَّ اللَّهَ مَعَ الصَّابِرِينَ ) (البقرة).

الأعمال التي تعين الإنسان على العفة

1 – الانشغال بعمل الخير.

2 – قرأه القرآن والذكر.

3 – الحرص على الصيام وأيضا الصلاة.

4 – الابتعاد عن أصدقاء السوء والجلوس معهم في أماكنهم.

من الأوجه التي وردت في قولُه تَعَالَى: (لَا يَجِدُونَ نِكَاحا ):

1 . لا يستطيعون دفع تكاليف الزواج بسبب فقرهم.

2 . امتناع اوليائهم واسيادهم عن تزويجهم.

3 . لا يجدوا من يزوج بناتهم.

ثالثا: تحريم البغاء واغلاق منافذه:

حرم الإسلام الزنا عموما، وخاصه البغاء، وهو الزنا باجر (الدعارة).

 فالبغاء تـجـاره في الجنس, فليس جريمة فرديه بين شخصين كالزنا،  بل تجاره تدار من خلال مجموعة يديرها أحد المجرمين، وهو الذي يسهل عملية البغاء، ويشجع على استغلاله لتحقيق مصالح مادية. والقوانين الإنسانية والدولية تحرمه.

محاربة الإسلام للبغاء

فالإسلام كان سباقا  في محاربة البغاء وتحريمه، ودعا إلى تحرير الرقيق خاصة الإماء، فقد كان وسيلة لكسب المال وزيادة  الإرقاء الأولادِ، وعنما حرم الإسلام ذلك وأمرَ بتزويج الإماء، فتح بذلك بابا كبيرا لتحرير الرقيق، وحفظ كرامة الإنسان، تماما كبـاب المكاتبة, فأعطى للرقيق الحق بتحرير أنفسهم، بمبلغ يتفقان عليه، وتشجيعا لذلك أمر بأن يدفعوا للمكاتب من أموالهم ومِنْ مَالِ الزّكاة ليخلص نفسه، وقد انتهت هذه الظاهرة، ويحاول بعض الناس إعادتها بأشكال أخرى (تجارة الرقيق الأبيض)، وتتصدى دولة الإمارات لها مع دول العالم.

كان لعبدالله بن سلول إماء، وكان يكرههن على البغاء بعد الإسلام رغبة في الكسب، فشكتْ إحداهن لأبي بكر الصديق رضي الله عنه فأخبر النبي صلى الله عليه وسلم، فنزل قوله تعالى: ( وَلَا تُكۡرِهُواْ فَتَيَٰتِكُمۡ عَلَى الۡبِغَآءِ إِنۡ أَرَدۡنَ تَحَصُّنٗا).

كما أن قوله تعالى: ﴿ وَلَا تُكْرِهُوا فَتيَاتكُمْ عَلَى الْبِغَاء إن أردنَ تَحَضُنَا ) يشير إلى الفطرة السليمة الكريمة في المرأة، وهي الإحصانُ والستر والعفة، ولا يفهم منه أنه شرط لعدم الإكراه على الزنا، لأن الزنا محرم أصلا، قال تعالى: ﴿ وَلَا تَقْرَبُوا الزِنَى إِنَّهُ كَانَ فَاحِشَةً وَسَاءَ سَبِيلًا ) (الإسراء).

كما أنه تحذير لبعض الناس من تعطيل زواج بناتهم، طمعا في مكاسب مادية أو معنوية؛ لأنـه قـد يوقعهن في الخطأ، أو يجعلهـن ضحايا لأصحاب النوايا الخبيثة.

مخاطر جريمة البغاء على الفرد والمجتمع

1-يترتب عليه جرائم كثيرة كالإكراه والخطف والمخدرات والقتل.

2- امتهان كرامة الإنسان.

3- انتشا ر الفساد والرذيلة وتفشي الأمراض الخطيرة

4- تفكك الأسر وضياع النسب.

5- والقتل والمخدرات.

6-  امتهان كرامة البشر.

تجارة الرقيق الأبيض معناها : إجبار النساء  على القيام بأعمال الدعارة فهو مصطلح حديث أطلق على استغلال النساء في الأعمال الغير أخلاقية.

مقارنة بين الزنا والبغاء

نجد أن كلاهما محرم وكلاهما ممارسة للجنس بشكل غير شرعي.

البغاء تجارة في الجنس بهدف تحقيق مصالح مادية.

والزنا جريمة فردية بين شخصين وغالباً تكون بدون مقابل.

آيات قرآنية للزواج

الحث على الزواج في الدين الإسلامي والترغيب فيه والتسهيل لطريقه طاعه لله – وحفظ الفرج وصيانه للأعراض والأنساب وحفاظا على غض البصر فبه لتتحقق الطمأنينة والراحة النفسية وما إلى غير ذلك من الفوائد العظيمة, وهذه آيات قرآنية للزواج:

 قال الله تعالى في سورة البقرة: ( وَلَا تَنْكِحُوا الْمُشْرِكَاتِ حَتَّى يُؤْمِنَّ وَلَأَمَةٌ مُؤْمِنَةٌ خَيْرٌ مِنْ مُشْرِكَةٍ وَلَوْ أَعْجَبَتْكُمْ وَلَا تُنْكِحُوا الْمُشْرِكِينَ حَتَّى يُؤْمِنُوا وَلَعَبْدٌ مُؤْمِنٌ خَيْرٌ مِنْ مُشْرِكٍ وَلَوْ أَعْجَبَكُمْ أُولَئِكَ يَدْعُونَ إِلَى النَّارِ وَاللَّهُ يَدْعُو إِلَى الْجَنَّةِ وَالْمَغْفِرَةِ بِإِذْنِهِ وَيُبَيِّنُ آيَاتِهِ لِلنَّاسِ لَعَلَّهُمْ يَتَذَكَّرُونَ).(البقرة)

قال الله تعالى في سورة البقرة: ( وَلَا جُنَاحَ عَلَيْكُمْ فِيمَا عَرَّضْتُمْ بِهِ مِنْ خِطْبَةِ النِّسَاءِ أَوْ أَكْنَنْتُمْ فِي أَنْفُسِكُمْ عَلِمَ اللَّهُ أَنَّكُمْ سَتَذْكُرُونَهُنَّ وَلَكِنْ لَا تُوَاعِدُوهُنَّ سِرًّا إِلَّا أَنْ تَقُولُوا قَوْلًا مَعْرُوفًا وَلَا تَعْزِمُوا عُقْدَةَ النِّكَاحِ حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ وَاعْلَمُوا أَنَّ اللَّهَ يَعْلَمُ مَا فِي أَنْفُسِكُمْ فَاحْذَرُوهُ وَاعْلَمُوا أَنَّ اللَّهَ غَفُورٌ حَلِيمٌ).

 قال الله تعالى في سورة النّساء: ( يَا أَيُّهَا النَّاسُ اتَّقُوا رَبَّكُمُ الَّذِي خَلَقَكُمْ مِنْ نَفْسٍ وَاحِدَةٍ وَخَلَقَ مِنْهَا زَوْجَهَا وَبَثَّ مِنْهُمَا رِجَالًا كَثِيرًا وَنِسَاءً) ( النساء)

قال الله تعالى في سورة النّساء: {وَإِنْ خِفْتُمْ أَلاَّ تُقْسِطُواْ فِي الْيَتَامَى فَانكِحُواْ مَا طَابَ لَكُم مِّنَ النِّسَاء مَثْنَى وَثُلاَثَ وَرُبَاعَ فَإِنْ خِفْتُمْ أَلاَّ تَعْدِلُواْ فَوَاحِدَةً أَوْ مَا مَلَكَتْ أَيْمَانُكُمْ ذَلِكَ أَدْنَى أَلاَّ تَعُولُواْ}.[٥] قال الله تعالى في سورة النّساء: {وَإِنْ أَرَدْتُمُ اسْتِبْدَالَ زَوْجٍ مَكَانَ زَوْجٍ وَآتَيْتُمْ إِحْدَاهُنَّ قِنْطَارًا فَلَا تَأْخُذُوا مِنْهُ شَيْئًا أَتَأْخُذُونَهُ بُهْتَانًا وَإِثْمًا مُبِينًا}.[٦]

قال تعالى في سورة الرّوم: ( وَمِنْ آيَاتِهِ أَنْ خَلَقَ لَكُم مِّنْ أَنفُسِكُمْ أَزْوَاجًا لِّتَسْكُنُوا إِلَيْهَا وَجَعَلَ بَيْنَكُم مَّوَدَّةً وَرَحْمَةً إِنَّ فِي ذَلِكَ لآيَاتٍ لِّقَوْمٍ يَتَفَكَّرُون)

 قال تعالى في سورة النّجم: ( وَأَنَّهُ خَلَقَ الزَّوْجَيْنِ الذَّكَرَ وَالْأُنْثَى}.[٨] قال الله تعالى في سورة النّور: {وَأَنْكِحُوا الْأَيَامَى مِنْكُمْ وَالصَّالِحِينَ مِنْ عِبَادِكُمْ وَإِمَائِكُمْ إِنْ يَكُونُوا فُقَرَاءَ يُغْنِهِمُ اللَّهُ مِنْ فَضْلِهِ وَاللَّهُ وَاسِعٌ عَلِيمٌ}.[٩] قال الله تعالى في سورة الرّعد: {وَلَقَدْ أَرْسَلْنَا رُسُلًا مِنْ قَبْلِكَ وَجَعَلْنَا لَهُمْ أَزْوَاجًا وَذُرِّيَّةً).

قال تعالى في سورة القصص: ( قَالَ إِنِّي أُرِيدُ أَنْ أُنكِحَكَ إِحْدَى ابْنَتَيَّ هَاتَيْنِ عَلَى أَن تَأْجُرَنِي ثَمَانِيَ حِجَجٍ فَإِنْ أَتْمَمْتَ عَشْراً فَمِنْ عِندِكَ وَمَا أُرِيدُ أَنْ أَشُقَّ عَلَيْكَ سَتَجِدُنِي إِن شَاء اللَّهُ مِنَ الصَّالِحِينَ).

 قال تعالى في سورة الأحزاب: ( يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا نَكَحْتُمُ الْمُؤْمِنَاتِ ثُمَّ طَلَّقْتُمُوهُنَّ مِنْ قَبْلِ أَنْ تَمَسُّوهُنَّ فَمَا لَكُمْ عَلَيْهِنَّ مِنْ عِدَّةٍ تَعْتَدُّونَهَا فَمَتِّعُوهُنَّ وَسَرِّحُوهُنَّ سَرَاحًا جَمِيلًا) .
